For most people in rural South Africa, traditional justice mechanisms provide the only feasible means of accessing any form of justice. These mechanisms are popularly associated with restorative justice, reconciliation and harmony in rural communities. Yet, this ethnographic study grounded in the political economy of rural South Africa reveals how historical conditions and contemporary pressures have strained these mechanisms’ ability to deliver the high normative ideals with which they are notionally linked. In places such as Msinga access to justice is made especially precarious by the reality that human insecurity – a composite of physical, social and material insecurity – is high for both ordinary people and the authorities who staff local justice forums; cooperation is low between traditional justice mechanisms and the criminal and social justice mechanisms the state is meant to provide; and competition from purportedly more effective ‘twilight institutions’, like vigilante associations, is rife. Further contradictions are presented by profoundly gendered social relations premised on delicate social trust that is closely monitored by one’s community and enforced through self-help measures like witchcraft accusations in a context in which violence is, culturally and practically, a highly plausible strategy for dispute management.? These contextual considerations compel us to ask what justice we can reasonably speak of access to in such an insecure context and what solutions are viable under such volatile human conditions? The book concludes with a vision for access to justice in rural South Africa that takes seriously ordinary people’s circumstances and traditional authorities’ lived experiences as documented in this detailed study. The author proposes a cooperative governance model that would maximise the resources and capacity of both traditional and state justice apparatus for delivering the legal and social justice – namely, peace and protection from violence as well as mitigation of poverty and destitution – that rural people genuinely need.

Peter Suber has been a leading advocate for open access since 2001 and has worked full time on issues of open access since 2003. As a professor of philosophy during the early days of the internet, he realized its power and potential as a medium for scholarship. As he writes now, "it was like an asteroid crash, fundamentally changing the environment, challenging dinosaurs to adapt, and challenging all of us to figure out whether we were dinosaurs." When Suber began putting his writings and course materials online for anyone to use for any purpose, he soon experienced the benefits of that wider exposure. In 2001, he started a newsletter -- the Free Online Scholarship Newsletter, which later became the SPARC Open Access Newsletter -- in which he explored the implications of open access for research and scholarship. This book offers a selection of some of Suber's most significant and influential writings on open access from 2002 to 2010. While the economic growth renaissance in sub-Saharan Africa is widely recognized, much less is known about progress in living conditions. This book comprehensively evaluates trends in living conditions in 16 major sub-Saharan African countries, corresponding to nearly 75% of the total population. It shows how some countries have seen little economic growth and progress for the poor whilst others have made impressive progress in key non-monetary indicators ofwellbeing.
Examining the new ecosystems of access that are emerging in middle- and low-income countries as opportunities for higher education expand but funding for materials shrinks. Even as middle- and low-income countries expand their higher education systems, their governments are retreating from responsibility for funding and managing this expansion. The public provision of educational materials in these contexts is rare; instead, libraries, faculty, and students are on their own to get what they need. Shadow Libraries explores the new ecosystem of access, charting the flow of educational and research materials from authors to publishers to libraries to students, and from comparatively rich universities to poorer ones. In countries from Russia to Brazil, the weakness of formal models of access was countered by the growth of informal ones. By the early 2000s, the principal form of access to materials was informal copying and sharing. Since then, such unauthorized archives as Libgen, Gigapedia, and Sci-Hub have become global “shadow libraries,” with massive aggregations of downloadable scholarly materials. The chapters consider experiments with access in a range of middle- and low-income countries, describing, among other things, the Russian samizdat tradition and the connection of illicit copying to resistance to oppression; BiblioFyL, an online archive built by students at the University of Buenos Aires; education policy and the daily practices of students in post-Apartheid South Africa; the politics of access in India; and copy culture in Brazil.
